These Terms and Conditions ("Terms") govern your use of the website at concretebryant.com and any services provided by Stronghold Bryant Concrete ("we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms. Please read them carefully before proceeding.
By using our website or requesting services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms. If you are acting on behalf of a business or property owner, you represent that you have the authority to bind that party to these Terms.
Stronghold Bryant Concrete is a licensed concrete contractor providing residential and commercial concrete services in Bryant, AR and surrounding areas. Our services include, but are not limited to, concrete driveway installation, patio construction, sidewalk building, foundation work, retaining walls, floor installation, stamped and decorative concrete, and concrete cutting. The specific scope of any project is defined in a written estimate or contract provided to you before work begins.
All estimates are provided in writing following an on-site assessment. Estimates are based on the conditions and scope visible at the time of the site visit and are valid for 30 days from the date issued. Final pricing is confirmed in a signed contract prior to the start of work.
If unforeseen conditions are discovered during the course of work - such as hidden structural issues, unexpected soil conditions, or additional scope requested by the customer - we will notify you promptly and provide a written change order before proceeding. We do not perform additional work without your prior written authorization.
Concrete work is weather-dependent. We reserve the right to reschedule a project start date due to rain, extreme temperatures, or other weather conditions that would compromise the quality of the work. We will notify you as soon as possible if a rescheduling is necessary.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before the scheduled start date may result in a cancellation fee to cover costs already incurred for materials, permitting, or crew scheduling.
If a deposit has been paid and you cancel before materials are ordered or permits are pulled, a refund will be issued minus any non-recoverable costs incurred. Once materials have been ordered or work has begun, the deposit is non-refundable.
Payment terms are outlined in your written contract. Typical terms require a deposit upon signing the contract, with the balance due upon substantial completion of the work. We accept payment by cash, check, and major credit cards unless otherwise agreed in writing.
Accounts not paid within the terms of the contract are subject to a late payment fee and may be referred for collection. You are responsible for all reasonable costs of collection, including attorney fees, if your account is placed with a collection agency or attorney due to non-payment.
You are responsible for ensuring that the work area is accessible on the scheduled start date, including unlocking gates, moving vehicles, and removing personal property from the work zone. We are not responsible for delays caused by inaccessible work areas or conditions not disclosed at the time of the estimate.
If your property is governed by a homeowners association, you are responsible for obtaining any required HOA approvals before work begins. We are not responsible for fines, disputes, or required removals resulting from unapproved work when the customer failed to secure HOA approval.
We stand behind our work. If a defect in materials or workmanship becomes apparent within one year of project completion, contact us and we will assess the issue and make it right at no charge, provided the defect is not caused by customer misuse, outside damage, or normal wear.
Hairline cracks in concrete are a normal characteristic of the material and are not considered a defect. Control joints are installed to manage where cracking occurs - a hairline crack along a control joint is the system working as designed. Cosmetic surface variation in stamped or colored concrete is also normal and not covered under workmanship warranty.
Except as expressly stated in Section 7, all services are provided "as is" without any other warranty, express or implied, including implied warranties of merchantability or fitness for a particular purpose. We do not warrant that our work will meet every expectation or that the results will be free from all defects under every possible condition.
To the fullest extent permitted by law, Stronghold Bryant Concrete is not liable for any indirect, incidental, special, or consequential damages arising out of or related to our services or your use of our website. This includes, without limitation, loss of profits, loss of use, or damages arising from delays or unforeseen conditions.
Our total liability to you for any claim arising from services we provide will not exceed the amount you paid us for the specific project giving rise to the claim.
If a dispute arises between you and Stronghold Bryant Concrete regarding our services or these Terms, we ask that you first contact us directly at projects@concretebryant.com to attempt to resolve the matter. We are committed to fair and prompt resolution of any legitimate concern.
If direct resolution is not possible, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association in Bryant, AR. Both parties waive the right to a jury trial for any claim covered by these Terms. Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction.
These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of law provisions. Any legal action not subject to arbitration will be brought exclusively in the state or federal courts located in Saline County, Arkansas.
